PRIVACY POLICY — YOUR DATA, EXPLAINED.
What we collect, why we collect it, who we share it with, and the control you have over it.
This Privacy Policy explains how Perfex Capital ("we", "us", "our") collects, uses, shares and protects personal information when you use www.perfexcapital.com, submit an enquiry, or contact us by phone, email, WhatsApp or Instagram.
We are based in Gujarat, India, and we handle personal information in accordance with applicable Indian law, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and the rules made under them.
1. Who we are
Perfex Capital is an independent loan consultancy based in Gujarat, India. We help individuals and businesses understand and access financing options for education, vehicle, home, business and personal loans.
In relation to the personal data you provide to us, we decide why and how that data is processed — that is, we act as a Data Fiduciary under the Digital Personal Data Protection Act, 2023.
2. What we collect
Information you give us
- Through the enquiry form: your name, phone number, email address (optional), the loan type you select, and the requirement you describe.
- By phone, email, WhatsApp or Instagram: your contact details, and whatever you choose to tell us about your financing requirement or your application.
- During an application: where you ask us to help with an application, documents and details that a lender requires. We will tell you what is needed before you share it.
Information collected automatically
- Server logs: like most websites, our hosting provider records technical information about each request — such as IP address, browser and device type, the pages requested, and the date and time.
3. What we ask you not to send us
Please do not send us your bank or ATM PIN, net-banking or card password, CVV, full card number, UPI PIN, or any one-time password (OTP).
We will never ask you for a PIN, password or OTP — not through this Website, not by email, not on WhatsApp, and not over the phone. If someone contacts you claiming to be from Perfex Capital and asks for these, please do not share them and let us know straight away.
4. How we use your information
- To respond to your enquiry and get in touch about it.
- To understand your requirement and explain the financing options that may suit it.
- To share your details with lenders, banks or NBFCs so they can assess your eligibility — where you have asked us to do this.
- To keep you informed about the progress of an application.
- To operate, maintain, secure and improve the Website.
- To meet legal, regulatory and accounting obligations, and to establish, exercise or defend legal claims.
5. Consent and legal basis
We process your personal information on the basis of the consent you give when you submit the enquiry form or contact us. Where applicable, we also process it to perform a service you have asked for, and to comply with our legal obligations.
You can withdraw your consent at any time by writing to us using the details in the "Grievance Officer" section below. Withdrawing consent does not affect processing that already took place, and it may mean we can no longer assist with your enquiry or application.
You also have the right to nominate another person to exercise your rights on your behalf in the event of your death or incapacity, as provided under the Digital Personal Data Protection Act, 2023.
6. Who we share it with
We do not sell your personal information. We share it only as described here:
- Lenders, banks and non-banking financial companies — so that they can assess your application. We do this where you have asked us to help and have agreed to this sharing.
- Service providers who support our operations, such as our web hosting provider, which stores and processes data on our behalf under our instructions.
- Google reCAPTCHA — the contact form is protected by Google reCAPTCHA, which helps us tell genuine enquiries from automated ones. To provide that check, Google receives your IP address and information about your browser and device. This is used only for security and abuse prevention, and only on the page that carries the form.
- Professional advisers, where reasonably needed for advice or to establish, exercise or defend legal claims.
- Government and regulatory authorities, where disclosure is required by law, or by a lawful order.
7. Cookies and tracking
This Website does not use advertising, analytics or profiling cookies, and we do not run third-party advertising or analytics trackers on it.
One exception is the contact form, which uses Google reCAPTCHA to keep automated submissions out. Google may set cookies and collect your IP address and browser details to run that check. It is used solely for security and abuse prevention — never for advertising, analytics or profiling — and it is loaded only on the contact page.
Our hosting and content-delivery provider may use strictly necessary technical cookies or similar mechanisms to deliver pages securely and to protect the Website from abuse. We do not use these to build a profile of you.
You can control or delete cookies through your browser settings. Blocking strictly necessary cookies may affect how the Website works.
8. Hosting and server logs
This Website is hosted on servers operated by our hosting provider. As with any website, those servers record requests — including IP addresses — for security and diagnostic purposes.
We do not use these logs to identify individuals, except where it is necessary to investigate abuse, fraud or a security incident, or where we are required to by law.
9. How long we keep your information
We keep enquiry details for as long as we need them to respond to you and to support any application we are assisting with. Afterwards, we keep them only for as long as we must to meet legal, regulatory, accounting or record-keeping requirements, or to resolve disputes.
When information is no longer needed, we delete or anonymise it.
10. How we protect your information
We take reasonable technical and organisational measures to protect personal information. These include transmitting the enquiry form over an encrypted HTTPS connection, and limiting access to enquiry details to those who need it to help you.
No method of transmission or storage is completely secure, so please avoid sending highly sensitive information through the Website, email or WhatsApp — see What we ask you not to send us.
11. Your rights
Subject to applicable law, you may ask us to:
- Confirm and summarise whether we process your personal information, and give you a summary of it.
- Correct, complete or update information that is inaccurate, incomplete or out of date.
- Erase your personal information, where it is no longer needed for the purpose it was collected for.
- Withdraw your consent to processing.
- Nominate another individual to exercise your rights in the event of your death or incapacity.
To make a request, contact us using the details below. We may need to verify your identity before we act, and we will respond within the time required by applicable law.
12. Grievance officer
If you have a question, concern or complaint about how we handle your personal information, please contact our Grievance Officer:
- Grievance Officer, Perfex Capital — Gujarat, India
- Email: perfexxcapital@gmail.com
- Phone: +91 8160490775
We will acknowledge your complaint and work to resolve it. If you are not satisfied with our response, you may also complain to the Data Protection Board of India.
13. Children
This Website and our services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, please contact us and we will delete it.
14. Changes to this policy
We may update this Privacy Policy from time to time. The current version is always published on this page, and the "Last updated" date above will change whenever we do.
